This Tuesday, February 21, could have been an important date for the cannabis world, but it was not. The parliamentary group of Esquerra Republicana de Cataluña (ERC), presented, in front of an almost empty hemicycle, its proposal for the regularization and legalization of cannabis under the premise that the non-regulation of this substance favors the rise of mafias, the black market and the impossibility for users to use CBD products freely in public spaces or as a treatment for ailments.
The proposal was finally rejected by PP, VOX and PSOE with 75 votes in favor, 263 against and 9 abstentions, thus failing to achieve the desired objective.
We leave you a link to all the interventions of the plenary session on the legalization of CBD on this topic and below several that we have selected with different arguments for and against.
Increased legalization
One of the most important trends in the CBD industry in Spain is the legalization of cannabis. In recent years, several regions in Spain have decriminalized cannabis use and medical cannabis is now legal throughout the country. This increasing legalization is expected to pave the way for greater adoption of CBD products as consumers become more comfortable with the idea of using Cannabis-derived products.
2018 and the legal setback for CBD.
In 2018 CBD went from being overnight a dietary supplement to an illegal substance to be sold under that category. It was only allowed to remain as a product intended for cosmetic purposes.
Why wasn’t CBD definitively outlawed in Spain?
Here the EU came to the rescue with the ruling of January 19, 2020, of the European Court of Justice. In it, the proposal to legalize CBD was approved, presenting studies and affirmations that supported that this molecule present in hemp plants and flowers does not contain psychoactive components or other substances harmful to health.
This led to the legalization of the use and commercialization of CBD products throughout Europe. As it was Europe’s highest chamber that gave the ruling, the rest of the member countries had to abide by it, although they were free to apply the legal regulations to control its use, but without outlawing CBD or its derivatives.
Increasing popularity of CBD products
As more people become aware of CBD products and their various uses, it is likely that the popularity of these products will continue to increase. This could lead to increased competition among CBD brands as companies strive to differentiate themselves and grab a share of the growing market. In addition, as the industry matures, we can expect to see a wider range of CBD products available, including more innovative formulations and delivery methods.
Increased regulation and quality control
As the CBD industry grows, greater oversight and quality control measures will be put in place to protect consumers. This could include stricter labeling requirements, mandatory testing for pollutants and potency, and increased scrutiny of commercial claims. While this could pose a challenge for smaller CBD companies, it is ultimately good news for consumers, who can feel more confident in the safety and efficacy of the products they buy.
How does Greenery cope with these controls?
All our products are tested and verified by an independent laboratory that certifies the quality of the products, that they are free of harmful chemicals and in turn analyzes the THC and CBD concentrations of all products.
These reports on any of our products are available to any user upon request.
Conclusions on the future of CBD
Overall, the future of CBD in Spain looks promising. With increased legalization, growing popularity, increased regulation and quality control, and increased education and awareness, the stage is set for continued growth and innovation in the CBD industry.
